Renting a Shop in Levent Carsi: A Lease and Licence Checklist

What to check before renting a shop in Levent Carsi: permitted use and licensing, title, lease term, limits on rent increases and deposits, assignment, costs and footfall at different times.

Renting a Shop in Levent Carsi: A Lease and Licence Checklist

Businesses looking to rent a shop in Levent Carsi usually focus first on location, shop window and footfall. These are the right starting points, but if permitted use, licensing and lease terms are not clarified before signing, the first years of the business can bring unexpected costs. When looking for a shop on this neighbourhood shopping street within Levent's residential fabric, we recommend checking the following points one by one.

1. Confirm that the shop suits your intended use

Not every shop suits every business. Before signing, confirm that the zoning and occupancy status allow your intended use and that a business opening and operating licence can be obtained from the municipality. For food and beverage uses such as cafes, delicatessens or restaurants, the flue, ventilation and technical infrastructure must be checked separately.

2. Check the landlord's authority

Check through the title deed, and any power of attorney, that the person signing is the owner of the shop or is authorised to contract on the owner's behalf. For shops in shared ownership, also ask about the position of the other co-owners.

3. Understand the lease term and renewal

Under the Turkish Code of Obligations, for residential and roofed business premises, a fixed-term lease is deemed renewed for one year on the same terms unless the tenant gives notice at least fifteen days before it expires; the landlord cannot end the lease simply because the term has expired (Art. 347). Notices of termination must be given in writing (Art. 348).

4. Write the rent review clause within the legal limit

An agreement on the rent for a renewed lease year is valid as long as the increase does not exceed the change in the twelve-month average of the consumer price index for the previous lease year. For leases longer than five years or renewed after five years, the rent may be set by the court on an equitable basis (Art. 344).

5. Know the deposit limit and how it is held

For roofed business premises, the security deposit may not exceed three months' rent. If it is paid in cash, it is placed in a time deposit account that cannot be withdrawn without the landlord's consent (Art. 342).

6. Clarify assignment and subletting

The tenant may not transfer the lease without the landlord's written consent; in business premises leases, the landlord may not refuse this consent without good cause (Art. 323). Subletting the shop or transferring the right of use also requires the landlord's written consent (Art. 322). If you may want to transfer the business in future, discuss this at the outset.

7. Put costs and fit-out in the lease

Who bears service charges and common costs, signage approval and fit-out expenses should be stated clearly in the lease. Recording the condition at handover in a dated, photographed report reduces disputes when the lease ends.

8. Observe the street at different days and times

Levent Carsi's customers include local residents and professionals working in the offices on Buyukdere Street on weekdays, so footfall can differ between weekdays and weekends and between morning, midday and evening. Watching the street at different days and times, rather than on a single visit, makes the leasing decision sounder.

9. Assess neighbouring businesses and competition

Many businesses targeting the same customers can increase competition for a newcomer, while a service that is not yet well represented on the street can be a bigger opportunity. Before renting, look at the sectors, product and service range, price level and customer density of the businesses around you.
